Terms of use

1. Purpose
These terms of use (the “Terms”) govern access to and use of the Greenflag mobile application (the “Service”), published by ELLEM-AI, a simplified joint-stock company with a sole shareholder (SASU) with share capital of €1,000, registered with the Clermont-Ferrand Trade and Companies Register under number 101 130 359, whose registered office is located at 23 Impasse du Guéry — 63000 Clermont-Ferrand. By using Greenflag, you accept these Terms without reservation.
2. Description of the Service
Greenflag is a real-time dating application based on physical co-presence. You take an in-the-moment photo, start a scan, and can send a “Greenflag” (a signal of interest) to people present in the same place. At any time you can become invisible during the moment. The Service is designed to be ephemeral: active visibility is limited to 3 hours; if you have sent a greenflag, your card may remain visible to that person, in an “expired” state (photo hidden), until your data is automatically deleted (within 12 h at the latest).
3. Access and age requirement
Use of Greenflag is strictly reserved for natural persons of full age, 18 years old and over. The Publisher knowingly collects no data relating to minors. If you are under 18, you are not permitted to download, to register, or to use the Service.
- On first access, you certify by sworn statement that you are of full age (18 or over) by ticking a dedicated box.
- No registration is required: access relies on a pseudonymous key generated on the device.
- You must have a compatible device and an internet connection.
4. Rules of conduct
By using Greenflag, you undertake not to:
- publish illegal, hateful, violent, harassing or sexually explicit content;
- publish another person's photo without their consent;
- impersonate a third party;
- use the Service for commercial, advertising or canvassing purposes;
- attempt to circumvent the moderation, the security or the technical limitations of the Service;
- collect or record other people's data or photos.
5. Photos and moderation
Photos are taken by camera only (no import from the gallery) and are subject to automated moderation before being published. Greenflag reserves the right to refuse, hide or delete any content that breaches these Terms, and to restrict a person's access in the event of a breach.
Zero tolerance for illegal content. Any manifestly illegal content, and in particular any child sexual abuse material or content involving minors, is immediately deleted, access to the Service is blocked, and the facts are reported to the competent authorities in accordance with the law (in particular the PHAROS platform of the French Ministry of the Interior).
6. Content rules
Greenflag is a space for meeting in the moment. To preserve the model and everyone's safety:
- Sharing contact info (phone number, social network handles, “@”…) in free-text fields (nickname, greenflags, redflags) is not allowed: your contact info is shared at the time of leaving, through the social network relay provided for that purpose.
- Hateful, threatening, discriminatory or sexually explicit remarks are prohibited.
These rules are enforced by automated moderation: any non-compliant content is blocked before publication.
7. Reporting, blocking and notification of illegal content
At any time you can report or block another person directly from the application. Every report is reviewed and may lead to measures, including restriction or suspension of access to the Service.
Notification of illegal content (Regulation (EU) 2022/2065, the “DSA”). Any person, whether or not they use the Service, may notify the presence of allegedly illegal content through the built-in notice and action mechanism (“Report”) or by email to connect@appgreenflag.com, which is the point of contact for Greenflag. To be processed, the notification must state: the date, the contact details of the person submitting the notification, a description of the disputed content and its location within the application.
Upon receipt of a notification concerning manifestly illegal content (in particular condoning crimes against humanity, incitement to hatred, child sexual abuse material), Greenflag proceeds with the immediate and preventive removal of the content and reserves the right to suspend, without notice or compensation, the access token of the person who originated the content. Any person submitting an abusive or bad-faith notification is liable to prosecution, in accordance with Article 6 of the LCEN.
8. Payments
8.1 Paid features and prices
Certain features of the Application give rise to a micro-payment (a single in-app purchase). Two independent options are offered, priced at €1 (one euro) each:
- Register your social network so that you remain reachable after your moment by the people with whom you have a mutual greenflag — €1;
- View the social network of a person with whom you have a mutual greenflag, once their moment has ended — €1.
Prices are stated inclusive of all taxes. The exact amount, in your currency, is confirmed to you by the store (App Store or Google Play) before the payment is validated.
8.2 Payment methods
Payments are processed exclusively through the secure native payment systems made available by the download platforms (Apple App Store In-App Purchase and Google Play Billing). The terms governing invoicing, payment and the processing of bank details are governed by the terms and conditions of the respective platforms (Apple and Google), which you accept when creating your download account.
8.3 Express waiver of the right of withdrawal
In accordance with Article L. 221-28 13° of the French Consumer Code, the right of withdrawal may not be exercised for contracts for the supply of digital content not supplied on a tangible medium where performance has begun after the consumer's prior express agreement and express waiver of their right of withdrawal.
By validating your purchase within the Application to instantly unlock a feature (in particular the display or the viewing of a social network), you:
- expressly consent to the immediate performance of the digital service before the end of the statutory period of fourteen (14) clear days;
- acknowledge and expressly accept that you thereby waive, as of right, the ability to exercise your right of withdrawal. No refund can be made once the digital content has been unlocked.
9. Intellectual property
The Greenflag trade mark, the logo, the interface and the elements of the Service are protected. You retain the rights to the photos you take, and you grant Greenflag a limited and temporary licence to host and display them, strictly necessary for the operation of the Service and limited to the ephemeral lifetime of the content.
10. Availability and liability
The Service is provided “as is”. Greenflag endeavours to ensure its availability but cannot guarantee uninterrupted operation. Greenflag acts as an intermediary putting people in touch and is not liable for the behaviour, remarks or encounters occurring between the people who use it. You remain responsible for your own safety when meeting in person.
11. Personal data
The processing of your data is described in our privacy policy.
12. Termination
You can stop using the Service at any time. Uninstalling the application and the automatic erasure of the data put an end to your use. Greenflag may suspend access in the event of a breach of these Terms.
13. Changes to the Terms
Greenflag may amend these Terms. The update date appears at the top of the page. Continued use constitutes acceptance of the amended Terms.
14. Governing law
These Terms are governed by French law. Any dispute falls within the jurisdiction of the competent courts, subject to the applicable provisions protecting consumers.
15. Consumer mediation
In accordance with the provisions of the French Consumer Code concerning “the consumer dispute mediation process”, after sending us a written complaint at connect@appgreenflag.com and failing a satisfactory reply, you have the option of using a consumer mediation procedure free of charge with:
